Statement

Upon arrival at the scene Officer Virgen witnessed a Felon Breach of the Peace, assault and battery by a tow truck driver. My wife and I brought it to the attention of both Officer Virgen and his Sergeant. Both Officer Virgen and his sergeant decided to allow the felony breach of the peace to continue for over 45 minutes and instead choose to act as a debt collector and attempt to verify the alleged debt for the tow driver attempting the repo. After numerous calls by Sergeant Quichocho to a private number identified by a FOIA request, the two officers decided to arrest the victim of the Felony breach of the peace, assault and battery on misdeameanor charges, thus committing Misprison of a felony under the Texas Penal Code 38.171 and title 18 United States Code § 4.
